These Event Terms and Conditions ("Event Terms") apply to all events listed, hosted, or facilitated through the U-Crew platform, whether paid or free. These Event Terms must be read in conjunction with U-Crew’s Terms and Conditions. By registering for or attending any event, you agree to be bound by these Event Terms and the U-Crew Terms and Conditions.
1. Introduction and Acceptance
By using the U-Crew Platform, you acknowledge that you have read, understood, and agree to be bound by these Event Terms and Conditions. In the event of any inconsistency or conflict between these Event Terms and the U-Crew Platform Terms and Conditions, the U-Crew Platform Terms and Conditions shall prevail to the extent of the inconsistency.
2. Role of U-Crew
U-Crew provides a facilitative platform for event registration and communication but is not a party to any agreement between event Organisers and Participants. All arrangements, including but not limited to event delivery and conduct at the event, are the responsibility of the event Organiser unless otherwise stated. U-Crew’s obligations are limited to the operation of the U-Crew platform as outlined in these Event Terms and U-Crew’s Terms and Conditions.
U-Crew does not conduct safety checks or risk assessments for events listed on its platform. It is the sole responsibility of Organisers and Participants to ensure that all safety requirements and risk management protocols are observed.
Where notification is required under these Event Terms, such notification must be provided through the U-Crew platform, unless otherwise specified.
3. Event Types
3.1. Free Events
Registration for free events is subject to availability and may be limited to a certain number of attendees. While no payment is required, attendees should notify us at least 24 hours in advance if unable to attend to allow others the opportunity to participate. Repeated registration without attendance may result in restrictions on future registrations.
3.2. Paid Events
Full payment is required at the time of registration to secure your place at a paid event. Cancellations must be submitted via the U-Crew Platform prior to the Event Start Date. If cancellation is made within the timeframe specified in the Listing, a full refund will be granted less any applicable Service Fees.
Partial refunds may be issued at the Organiser's discretion based on timing and circumstances. No refunds will be provided for cancellations made after the Event Start Date unless otherwise specified in the Listing or required by applicable consumer protection laws.
If an Organiser cancels a confirmed Event, the Participant will receive a full refund (less any Service Fees). Repeated cancellations by Organisers may result in penalties, listing restrictions, or account suspension.
4. Event Participation and Operations
Attendees with accessibility needs or special requirements should notify us at registration or as soon as possible, and we will make reasonable efforts to accommodate these needs. Participation in certain events may be restricted by age as clearly stated in the event listing, and by registering you represent that you meet any minimum age requirement.
All attendees must behave professionally and respectfully in accordance with the U-Crew Code of Conduct (listed below) and comply with health and safety protocols at the event venue. Organisers reserve the right to refuse entry or remove attendees who engage in disruptive, inappropriate, or offensive behaviour (including harassment, discrimination, abusive language, intoxication, or conduct interfering with others' enjoyment) or who fail to comply with health and safety requirements. Such removal may occur without prior notice or refund, and the Organiser's decision is final
5. Content and Intellectual Property
All materials presented at events, including but not limited to slides, handouts, and recordings, are protected by copyright and may not be reproduced, distributed, or shared without the express permission of the Organiser. Organisers warrant that any images, descriptions, or other content uploaded to the Platform do not infringe the intellectual property rights of any third party. U-Crew may remove any content that is alleged to infringe such rights.
6. Privacy and Data Use
Personal information exchanged between the Organiser and Participant or provided to U-Crew shall be handled in accordance with U-Crew’s Privacy Policy and applicable laws. The U-Crew Privacy Policy is available on the Platform at www.u-crew.com.au, and outlines how personal information is collected, used, and protected in connection with the Event.
7. Photography and Recording
U-Crew or event Organisers may photograph, film, or record events for promotional or educational purposes. By attending, you grant permission to use your image and voice unless you notify U-Crew in writing before the event.
8. Liability, Risk and Waiver
8.1. Assumption of Risk and Waiver
To the fullest extent permitted by law, attendees acknowledge that participation in certain events, including but not limited to sports or other physically demanding activities, may carry inherent risks of injury, illness, or death. By registering for or attending such events, attendees voluntarily assume all risks associated with participation and agree that U-Crew shall have no liability whatsoever for any injury, loss, or damage arising from or in connection with such activities, whether caused by negligence or otherwise. Participants further expressly waive, release, and discharge U-Crew, the Organiser, and their respective officers, employees, and agents from any and all claims, demands, or
causes of action for any injury, loss, or damage arising from or in connection with participation in the event, except to the extent such liability cannot be excluded by law.
8.2. Organiser Insurance, Risk Disclosure, and Waivers
Event Organisers are responsible for ensuring that all required permits, insurance, and risk disclosures are in place for events involving hazardous activities. For events involving hazardous activities, Event Organisers may require Participants to sign a separate waiver or release of liability as a condition of participation. It is the responsibility of the Organiser to communicate and obtain any such waivers prior to the commencement of hazardous activities. U-Crew does not verify the adequacy of such insurance or disclosures and disclaims all responsibility in this regard.
8.3. Medical Fitness and Emergency Procedures
Attendees are responsible for ensuring they are medically fit to participate in any event activities and must notify Organisers of any relevant medical conditions prior to the event. Emergency procedures and contacts must be communicated to all Participants prior to the commencement of hazardous activities.
9. Limitation of Liability and Indemnity
9.1. Indemnity
Participants and Organisers agree to indemnify and hold harmless U-Crew, its officers, employees, and agents from any and all claims, liabilities, damages, or expenses (including legal fees) arising from or in connection with their participation in or organisation of any event, including but not limited to those involving hazardous activities.
9.2. Limitation of Liability Between Participants and Organisers
To the fullest extent permitted by law, Participants and Organisers agree that neither party shall be liable to the other for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with participation in or organisation of any event, except to the extent such liability cannot be excluded by law.
9.3. Mutual Indemnification Between Participants and Organisers
Participants and Organisers agree to indemnify and hold harmless each other from any and all claims, liabilities, damages, or expenses (including legal fees) arising from or in connection with their own acts or omissions in relation to the event, except to the extent caused by the other party’s negligence, willful misconduct, or breach of these Event Terms.
9.4. Notice and Cooperation
Each party must promptly notify the other of any claim for which indemnification is sought and cooperate in the defense of such claim.
10. Event Changes, Cancellations, and Force Majeure
The Organiser reserves the right to cancel any event due to low enrolment, organiser illness, or other circumstances beyond our control. In such cases, registrants will be notified as soon as possible and offered either a full refund (for paid events) or priority registration for a future event.
Neither party shall be liable for any failure or delay in performing their obligations under these Event Terms if such failure or delay results from events beyond their reasonable control, including but not limited to natural disasters, acts of government, or other unforeseeable events. U-Crew shall have the sole discretion to determine whether a force majeure event has occurred and any decisions made by U-Crew regarding force majeure events shall be final and binding on all parties.
11. Feedback, Complaints, and Dispute Resolution
Attendees are encouraged to provide feedback or raise complaints regarding any event by contacting us in writing through the U-Crew platform within 7 days of the event. We will review all feedback and complaints in accordance with our internal procedures.
In the event of a dispute arising from an Event Agreement, the Organiser and Participant must first attempt to resolve the matter in good faith through the U-Crew Platform’s communication tools. If the dispute is not resolved within 7 days of initial notification, either party may request U-Crew’s assistance in facilitating a resolution. Upon receipt of a dispute request, U-Crew will review all submitted evidence and will make a final and binding decision within 14 days. Both parties agree not to pursue claims outside the U-Crew Platform's dispute resolution process.
12. Communication and Off-Platform Transactions
All agreements and communications relating to the Event must be conducted via the U-Crew Platform. U-Crew is not responsible for, and will not enforce, any agreements or arrangements made outside the Platform.
Any agreements, payments, or arrangements made outside the U-Crew Platform are strictly prohibited and may result in suspension or termination of access to the Platform for the parties involved.
13. Miscellaneous
These Event Terms are subject to change by U-Crew. Updated versions will be posted on the Platform. Any clause deemed invalid will not affect the remainder of the Rental Terms. Time is of the essence for all obligations.
14. Legal Provisions
Nothing in these Event Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted, or modified by agreement. Where permitted by law, any liability of the Organiser, Participant, or U-Crew arising from a breach of such non-excludable consumer guarantees is limited, at U-Crew’s discretion, to the resupply of the services or the payment of the cost of resupplying the services.
If any provision of these Event Terms is found to be invalid or unenforceable, such provision shall be severed, and the remaining provisions will remain in full force and effect.
